Welcome to SMATON (“we”, “our”, or “us”). By downloading, accessing, or using our mobile applications — including SMATON User, SMATON Restaurant, and SMATON Delivery — you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before using the apps.


1. Acceptance of Terms

By using the SMATON apps, you confirm that you are at least 18 years old (or have legal guardian consent) and agree to these Terms and our Privacy Policy.
If you do not agree, please discontinue using the app.


2. Services Overview

SMATON provides on-demand supply and delivery services through its connected platforms:

  • SMATON User App – for customers placing material or food orders.

  • SMATON Restaurant App – for restaurant partners managing incoming orders.

  • SMATON Delivery App – for delivery partners fulfilling orders and logistics.

We strive to ensure timely, safe, and efficient delivery of all orders, subject to service availability and operational conditions.


3. User Responsibilities

You agree to:

  • Provide accurate, complete, and up-to-date information during registration.

  • Use the app only for lawful purposes.

  • Not misuse, hack, or disrupt the platform or services.

  • Respect delivery timelines and payment terms.

Any violation may result in account suspension or permanent deactivation.


4. Orders and Payments

  • All orders are processed only after full payment is received.

  • Payments are securely handled through trusted gateways like Razorpay.

  • SMATON is not responsible for failed or delayed payments caused by third-party systems.

  • Prices and availability of items may vary and are subject to change without notice.


5. Cancellations and Refunds

  • Orders can be canceled only before dispatch, depending on partner policy.

  • Refunds (if applicable) are processed to the original payment method.

  • For damaged, incorrect, or missing items, customers must notify SMATON support within 24 hours of delivery.


6. Delivery and Timeliness

While we strive for on-time deliveries, SMATON is not liable for delays caused by:

  • Traffic, weather, or natural calamities.

  • Technical issues or partner unavailability.

  • Force majeure or events beyond our control.


7. Data Privacy

Your personal information is collected and used as described in our Privacy Policy.
We never sell or share your data with unauthorized third parties.


8. Partner & Delivery Obligations

For restaurant and delivery partners:

  • You must comply with applicable laws and regulations.

  • Orders and deliveries must be handled safely and professionally.

  • Misconduct, fraud, or misuse of the platform may result in account termination.


9. Intellectual Property

All content, logos, designs, and trademarks in the app are owned by SMATON.
You may not copy, modify, distribute, or reuse them without written permission.


10. Limitation of Liability

SMATON will not be liable for:

  • Any indirect, incidental, or consequential damages arising from app use.

  • Service interruptions or loss of data due to external factors.

Your use of the app is at your sole risk.


11. Termination

We may suspend or terminate your account without prior notice if you violate these Terms, engage in fraudulent activity, or misuse the service.


12. Changes to Terms

SMATON reserves the right to modify or update these Terms at any time.
Continued use of the app after updates constitutes your acceptance of the revised Terms.


13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes shall fall under the jurisdiction of Hingoli Courts, Maharashtra.
